Baxi Group Limited and its operating companies ("the Baxi Group") are aware of how important it is that the personal data you provide to us is kept secure and that your privacy is respected.

In the course of conducting our business worldwide, the Baxi Group collects and processes personal data relating to our clients, shareholders, employees, suppliers, business partners, website visitors and other persons.

The Baxi Group follows a strict privacy policy to ensure that we maintain the confidentiality and integrity of your personal data. The Baxi Group's privacy policy is outlined below to enable you to understand how the Baxi Group handles your personal data, what data the Baxi Group may collect, for what purposes it will be used, how the data is safeguarded and to whom we may disclose the data.

Personal data is information that can be used, either directly or indirectly, to identify a living individual. Sensitive Personal Data is information relating to sensitive categories of information such as racial or ethnic origin, political opinions, religious beliefs, trade union membership, health or sexual orientation as religious beliefs, trade union membership etc. It is Baxi Group's policy not to process sensitive personal data without your explicit consent.

The Baxi Group's privacy policy is effective as of 06/01/2006 and has been compiled in light of the legislation currently in force within the UK. This policy is subject to alteration following amendments to the relevant legislation and is subject to variations in accordance with local legal and regulatory requirements.

The Baxi Group observes the privacy principles described below when processing your personal data.

What Information Does The Baxi Group Collect?

Generally speaking you can visit any of the Baxi Group's websites without the need to disclose or reveal personal data. However, in order to provide you with better customer service and inform you about products, promotions and services offered by the Baxi Group, certain Baxi Group websites will ask you to enter personal data.

Processing Of Your Personal Data

It is the Baxi Group's policy to only process your personal data with your consent, or in such circumstances as relevant legislation permits. We will only process sensitive personal data with your explicit consent, or if such processing is permitted by an applicable law.

The Group will not allow your personal data to be processed in a manner that is incompatible with the purposes for which the data was originally collected, unless you authorise otherwise or the processing is required by an applicable law.

We will undertake all reasonable steps to ensure that your personal data held by the Baxi Group remains accurate, adequate, relevant, up-to-date and ensure that it is not excessive for the purpose for which it is used. However, we rely on you to inform us of any changes to your personal data in order to do this. It is our policy not to hold data for longer than is necessary.

At the Baxi Group we respect your privacy, therefore if you so wish, you have the right to request that your personal data be removed from the Baxi Group's databases.

Your personal data will be processed in accordance with this privacy policy and your rights under the Data Protection Act 1998 are not affected.

To Whom Will The Baxi Group Share The Information It Receives?

The personal data you provide to the Baxi Group is an important part of our business. The Baxi Group may share your personal data as described below, but rest assured we are not in the business of selling your personal data to unrelated third parties:

  1. The Baxi Group may transfer personal data between its operating companies where it is necessary to do so in order to meet the purpose for which you have submitted the information and, unless you indicated otherwise, to keep you informed of products, services and promotions offered by the Baxi Group.
  2. The Baxi Group may transfer your personal data to third party agents and subcontractors who undertake certain functions on behalf of the Baxi Group ("relevant third parties"). In this instance the relevant third party acts as a data processor on our behalf and we remain the data controller, thus retaining responsibility for your personal data. The relevant third parties only have access to your personal data as is necessary for them to perform their duties and may not use it for any function other than as detailed in their written contract. All relevant third parties are required to comply with the Baxi Group privacy policy and relevant Data Protection Legislation. In particular, they must ensure that your personal data is kept confidential and that adequate security measures are in place.
  3. If for any reason, in the Baxi Group's sole discretion, the Baxi Group believes that it is reasonable to do so, the Baxi Group may disclose personal data that enables third parties to identify and contact you in the event that we need to bring legal actions against you, or to otherwise protect the interests of the Baxi Group.

By submitting your personal data on any of the Baxi Group's websites, you are providing us with your explicit consent to transfer your personal data to jurisdictions other than the UK and to relevant third parties.

Notice

When you submit your personal data to the Baxi Group it is on the understanding that the data controller is the Baxi Group and the data processor is either the Baxi Group or one of its relevant third parties. The purpose for which you are submitting the personal data will be outlined on the specific website.

Access To Your Personal Data

Individuals who have provided the Baxi Group with personal data are allowed reasonable access to that data held by the Baxi Group to verify, correct or request the data be deleted.

Your personal data will only be accessible and processed by the Baxi Group, its employees, suppliers, business partners and other parties, who, in order to perform their contracted obligations to the Baxi Group, require access to your personal data. In addition we may grant access to your personal data to third parties specified by you, or as authorised by law or a court order.

Security Of Your Personal Data

The Baxi Group, and its relevant third parties, undertakes that all appropriate, technical and organisational measures shall be taken against unauthorised or unlawful processing of, against accidental loss or destruction of, or damage or access to, your personal data.

Cookies

When viewing some of the Baxi Group websites we may store some data on your computer which automatically recognises your PC when you next login ("a cookie"). If you do not wish to receive our cookies please contact your IT department to ask them to configure your internet browser accordingly.

Compliance With This Policy

To ensure that the Baxi Group and its relevant third parties comply with this policy we will:

  1. Publish this policy on all our websites such that it is obvious and accessible to all relevant parties.
  2. Appoint a contact at the various Baxi operating companies who will be responsible for maintaining this privacy policy for that operating company and ensuring that their employees are trained appropriately.
  3. Ensure that this privacy policy is reviewed on an annual basis and complies with the prevailing legislation. The policy will be amended in light of changes in legislation.
